Terms of service
Effective October 27, 2026. These terms are an agreement between you and [Legal entity, LLC] ("we", "us"), which runs epk at http://localhost:3000 and in our mobile apps. By creating an account or using epk, you agree to them. If you use epk for a business or a team, you agree on its behalf and confirm you're allowed to.
1. Who can use epk
You must be at least 18 years old and able to enter a binding contract. One person may run several profiles (a media team, an artist and a promoter) under one login. You're responsible for everything done from your account and the profiles you manage, including by teammates you invite. Keep your password private and turn on two-step sign-in if you can. Tell us right away at [security@ email] if you think someone else got into your account.
During the beta, we may approve accounts by hand, limit who can join, and change or remove features.
2. Your content stays yours
You keep every right you have in what you upload or write: photos, video, audio, logos, bios, messages and pages ("your content"). We don't claim ownership of it.
To run the service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process (for example making previews, smaller sizes and video streams), display and deliver your content, only as needed to provide epk to you and to the people you share it with, and to keep backups. This license ends when your content is deleted from the service and our backups, except for copies you shared with others that they still keep in their own library (see section 4).
We never sell your content, never use it in advertising, and never use your photos to train AI models.
You promise that you own your content or have the rights to upload and share it the way you do, including any permissions needed from people who appear in it.
3. Sharing, deliveries and credit
When a media team delivers a gallery to an artist or shares a link, the media team chooses what the recipient can do: view only, download certain sizes, or download originals. Those choices are shown with the files. Recipients may use delivered work only as the media team allowed and must keep the photographer's credit with it. Removing or hiding a credit is not allowed.
Promoters and artists may request media and usage. A usage approval, with any conditions the media team sets, is an agreement between those users, not with us.
4. Deleting things
You can delete files, galleries, profiles and your account. Deleted files stay in the trash for 30 days, then are removed, including from backups within the following 30 days. If you delivered work to someone, the copy in their library is part of their account and stays there unless you revoke the delivery before it's accepted or they remove it. Invoices and payment records are kept for 7 years because tax law requires it.
5. Payments between users
Media teams can send quotes and invoices to their clients. Clients pay the media team directly, by the methods the media team lists (for example Zelle, bank transfer, cash, or card through the media team's own Stripe account). epk never holds, receives or moves that money, takes no cut, and isn't a party to those agreements. The media team is responsible for its prices, taxes, refunds and the work, and the client for paying. If there's a dispute, sort it out with each other; we can share the records we have. We don't add card surcharges.
6. Our plans
Paid plans, add-ons and how renewal, cancellation and refunds work are covered by the subscription terms, which are part of these terms.
7. What's not allowed
Follow the acceptable use policy. We may remove content or pause or close accounts that break it, break the law, or put other people or the service at risk. Where we reasonably can, we'll tell you why and give you a chance to fix it or download your content first.
8. Copyright complaints
If you think something on epk infringes your copyright, follow the copyright policy. We remove infringing content and close the accounts of repeat infringers.
9. Other people's services
Some features connect to other services you choose to link, like Google, Dropbox, Stripe, Spotify or Posh. Their terms apply to your use of them. We aren't responsible for them, and you can disconnect them at any time in settings.
10. Availability and changes
We work hard to keep epk running and your files safe, with copies at more than one company. Still, the service is provided "as is" and "as available". We may change, add or remove features. If we make a change that significantly reduces what a paid plan includes, we'll tell you at least 30 days ahead and you can cancel for a prorated refund.
11. Liability
To the extent the law allows: we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Nothing here limits liability that can't be limited by law, such as for fraud, gross negligence or wilful misconduct.
You'll cover us for claims brought by others that arise from your content or from your breaking these terms or the law, except where we caused the problem.
12. Ending
You can stop using epk and delete your account at any time, in the app or on the web. We may end these terms or close an account for serious or repeated breaches, with notice where we reasonably can. Sections 2 (for copies others keep), 4, 5, 11, 12 and 13 continue after the account ends.
13. Law and disputes
These terms are governed by the laws of the State of Wisconsin and the United States, without regard to conflict of law rules. Before filing a claim, contact us at [support@ email] so we can try to resolve it informally within 30 days. Claims go to the state or federal courts in Milwaukee County, Wisconsin, and you and we consent to those courts. If you live in a place whose consumer laws give you the right to bring a claim where you live, these terms don't take that right away.
14. Changes to these terms
If we change these terms in a meaningful way, we'll email account owners and show a notice in the app at least 30 days before the change applies, and ask you to accept the new version. Earlier versions stay available on request.
